The Redress Scheme Scotland was set up to compensate victims and survivors of child abuse in a care setting, and to recognise and acknowledge what happened to victims.

What is the Eligibility?

To be eligible for an application, the abuse (which can be emotional, physical, sexual, or include elements of neglect) must have occurred while the victim was a child (under the age of 18) and in an appropriate care setting, such as a children’s home in Scotland.  The abuse must have occurred before 1st December 2004 in Scotland.

Fixed payments and individually assessed awards.

Under the Redress Scheme people can apply for a fixed payout of £10,000. However if a person feels they deserve more, then a Panel may review their circumstances to decide if a higher payout is appropriate. The Redress Scheme offers a relatively simple process, with less proof being required in certain circumstances and the possibility of damages being awarded quicker than for instance in a civil court process. It is critical that independent legal advice though be obtained prior to making any type of application to ensure that you have the benefit of legal support and advice from the outset.

Things you should know about the Redress Scheme?

You should be aware of the following though if you accept an offer under the Redress Scheme:

You will be required to sign a waiver which will relinquish the right to raise any future civil proceedings

The abusers will escape public accountability

The payments are typically significantly less than those seen in historical abuse claims.  

What are my options?

Options can include using the Redress Scheme, filing a civil action, or seeking compensation from the Criminal Injuries Compensation Authority. Before making an informed decision, it is critical that you seek independent legal advice.
